Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Questcademy ("we", "us", or "our") governing your access to and use of the Questcademy website, applications, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform.

If you are accepting these Terms on behalf of an organisation (such as a school, district, or company), you represent and warrant that you have the authority to bind that organisation.

• General Users: You must be at least 16 years old (or the age of digital consent in your jurisdiction) to create an account independently.
• Students Under 16: Students under the applicable age of digital consent may use the Platform only with the consent and supervision of a parent, legal guardian, or authorised school representative.
• U.S. Users Under 13 (COPPA): In the United States, children under 13 may only use the Platform with verifiable parental consent or when a school or teacher consents on behalf of the parent/guardian for educational purposes.
• Schools and Institutions: Schools using Questcademy as part of their educational programme agree that they have obtained all necessary consents from parents/guardians for student participation.

3.1 Account Creation

To access most features, you must register for an account by providing accurate, current, and complete information (including email address and a secure password). You may also register using Google OAuth. You are responsible for maintaining the accuracy of your account information.

3.2 Account Security

You are solely responsible for safeguarding your login credentials and for any activity that occurs under your account. Passwords must meet our minimum security requirements (at least 12 characters with a mix of uppercase, lowercase, numbers, and special characters). You must notify us immediately at security@questcademy.edu if you suspect unauthorised access.

3.3 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent restrictions, manipulate progress data, or abuse the Platform is grounds for immediate termination.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial educational purposes, subject to these Terms. This licence does not include the right to:

• Reproduce, distribute, or publicly display any Platform content outside the normal use of the service.
• Use automated systems (bots, scrapers, or crawlers) to access the Platform or extract data.
• Reverse-engineer, decompile, or disassemble any part of the Platform.
• Sub-licence, sell, resell, or commercially exploit the Platform or its content.

The Platform supports multiple user roles. Each role carries specific responsibilities:

5.1 Students

Students use the Platform to engage with lessons, assessments, and learning pathways. Students must represent their own work honestly and must not share account access or manipulate mastery data.

5.2 Parents / Guardians

Parents may link to their children's accounts to monitor progress, create assignments, and communicate with teachers. Parents are responsible for ensuring they have legal authority over the children they link to and for supervising minors' use of the Platform.

5.3 Teachers

Teachers use the Platform to manage classrooms, create and assign content, review student performance, and provide feedback. Teachers must use student data only for legitimate educational purposes and in accordance with applicable data protection laws.

5.4 School Administrators

School administrators manage school-wide settings, teacher assignments, and aggregate student data. They are responsible for ensuring their school complies with these Terms and all applicable laws regarding student data.

5.5 System Administrators

System administrators have platform-wide access for configuration, audit governance, and regional settings. This role is restricted to authorised Questcademy personnel.

6.1 Our Content

All curriculum materials, lesson content, question templates, concept graphs, user interface designs, software code, trademarks, logos, and other intellectual property on the Platform are owned by or licensed to Questcademy and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute this content except as expressly permitted.

6.2 Your Content

You retain ownership of any original content you submit (such as discussion posts, written assignment responses, or profile information). By submitting content, you grant Questcademy a worldwide, royalty-free, non-exclusive licence to use, store, display, and process that content solely for the purpose of operating and improving the Platform.

6.3 Feedback

If you provide suggestions, feature requests, or other feedback, you grant us an unrestricted, irrevocable licence to use and incorporate such feedback without obligation to you.

Questcademy uses artificial intelligence to generate questions, hints, explanations, and adaptive learning pathways. You acknowledge that:

• AI-generated content is produced algorithmically and may occasionally contain errors. We review AI outputs through safety guardrails and human oversight, but do not guarantee absolute accuracy.
• AI features receive only de-identified pedagogical data (concept IDs, difficulty tiers, mastery summaries) — never your name, email, or other directly identifiable personal information.
• All AI-generated educational content is governed by our AI Safety Policy, which includes curriculum boundary enforcement, bias mitigation, and region-appropriate content filtering.
• AI features are supplementary tools; they do not replace professional teaching, medical advice, or expert guidance.

8.1 Free and Paid Tiers

Questcademy offers both free and paid subscription tiers. Free accounts have access to core learning features. Premium features may require a paid subscription.

8.2 Billing

If you subscribe to a paid plan, you agree to pay all applicable fees. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. Prices are stated in the local currency applicable to your region and are inclusive of any applicable taxes unless otherwise stated.

8.3 Refunds

Refund requests may be submitted within 14 days of purchase if you have not substantially used the paid features during that period. We evaluate each request on a case-by-case basis. Statutory consumer rights under your applicable law are not affected.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Upload or transmit viruses, malware, or any code designed to interfere with the Platform's functionality.
• Attempt to gain unauthorised access to other users' accounts, the Platform's infrastructure, or related systems.
• Manipulate mastery scores, assessment results, or learning records through cheating, automation, or any dishonest means.
• Harvest, scrape, or collect personal information of other users without authorisation.
• Use the Platform to bully, harass, threaten, or intimidate other users.
• Circumvent any access controls, rate limits, or security features.

10.1 By You

You may delete your account at any time through your account settings or by contacting us. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

10.2 By Us

We reserve the right to suspend or terminate your account, temporarily or permanently, with or without notice, if we reasonably believe you have violated these Terms, engaged in prohibited conduct, or if required by law. Where possible, we will provide notice and an opportunity to address the issue before permanent termination.

10.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTCADEMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or free of harmful components.
• Content (including AI-generated content) will be accurate, complete, or current.
• Use of the Platform will result in any specific academic outcomes, exam scores, or educational achievements.

Questcademy is a supplementary educational tool. It does not replace formal schooling, professional tutoring, or expert academic advice.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUESTCADEMY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under the laws of Ghana, Nigeria, the United States, or your jurisdiction.

You agree to indemnify, defend, and hold harmless Questcademy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of the Platform.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Content you submit or transmit through the Platform.

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict-of-law principles. For users in Nigeria, Nigerian consumer protection laws apply to the extent they provide greater protection. For users in the United States, applicable federal and state laws (including COPPA and FERPA) also apply.

14.2 Dispute Resolution

We encourage you to contact us first at legal@questcademy.edu to resolve any dispute informally. If a dispute cannot be resolved within 30 days, either party may submit it to binding arbitration administered under the rules of the Ghana Arbitration Centre. The arbitration shall be conducted in English in Accra, Ghana.

14.3 Class Action Waiver

Where permitted by applicable law, you agree that disputes will be resolved on an individual basis and that you will not bring or participate in any class, consolidated, or representative action against Questcademy.

We may update these Terms from time to time. When we make material changes, we will notify you via an in-app notification or email at least 14 days before the changes take effect. The "Effective date" at the top of this page reflects the most recent revision. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.
